Terms of Service

1. Who We Are

Elimora is an online hiring marketplace operated in Kenya that connects Teachers Service Commission (TSC)-registered teachers with private and international schools. Our platform enables teachers to create verified profiles and schools to search, shortlist, and contact qualified educators.

2. Acceptance of Terms

By accessing or using the Elimora platform (“Platform”), you confirm that you have read, understood, and agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, you must not use the Platform.

3. Eligibility

You must be at least 18 years old to register. By creating an account, you represent that you are either:

• A teacher registered with the Teachers Service Commission (TSC) of Kenya, or
• An authorised representative of a private or international school operating in Kenya.

4. Account Responsibilities

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must provide accurate, current, and complete information during registration and keep it up to date. You must not share your account credentials with others.

5. Teacher Obligations

Teachers using the Platform represent and warrant that:

• All information provided — including TSC number, National ID, qualifications, and employment history — is truthful and accurate.
• They hold a valid TSC registration and will promptly update their profile if their registration status changes.
• They have obtained consent from any referees listed on their profile before providing their contact details.
• They will not create multiple accounts to circumvent platform rules.

6. School Obligations

Schools using the Platform represent and warrant that:

• They are a legally registered educational institution in Kenya.
• Teacher contact information obtained through the Platform will be used solely for legitimate hiring purposes.
• They will not share, resell, or distribute teacher data to third parties.
• They will contact teachers only for genuine employment opportunities.

7. Verification Disclaimer

Elimora performs format validation and cross-referencing of TSC numbers submitted by teachers. A “TSC Verified” badge indicates that the number has been reviewed by our team against the TSC register at the time of verification. It does not constitute a guarantee of a teacher’s competence, character, conduct, or ongoing TSC registration status. Schools are solely responsible for conducting their own due diligence before making any hiring decision.

8. Subscriptions and Payments

Access to teacher contact details requires an active school subscription at KES 4,500 per month (or as advertised on the Platform). Payments are processed securely by Paystack Incorporated. Subscriptions renew automatically each month until cancelled. Cancellation takes effect at the end of the current billing period. See our Refund & Cancellation Policy for refund eligibility.

8a. Trust, Safety & Disputes

We maintain a dedicated Trust & Safety process for reporting fake or fraudulent teacher profiles, misuse of teacher data, and disputes arising from platform interactions. 9. Prohibited Conduct

Users may not:

• Submit false, misleading, or fraudulent information on their profile or in communications.
• Impersonate any person, school, or entity.
• Create multiple accounts to circumvent subscription or verification requirements.
• Attempt to scrape, harvest, or extract data beyond their authorised access level.
• Contact teachers for any purpose other than legitimate employment.
• Interfere with the Platform’s security, authentication, or payment systems.
• Engage in any activity that violates applicable Kenyan law, including the Kenya Data Protection Act, 2019.

10. Intellectual Property

All content on the Platform — including the Elimora name, logo, design, and software — is the property of Elimora and is protected by Kenyan intellectual property law. You may not reproduce, distribute, or create derivative works without our express written permission. Teacher-uploaded content (CVs, certificates) remains the property of the teacher.

11. Limitation of Liability

The Platform is provided “as is” without warranties of any kind. To the maximum extent permitted by Kenyan law, Elimora is not liable for any direct, indirect, incidental, or consequential damages arising from your use of the Platform — including hiring outcomes, lost business opportunities, or reliance on teacher profiles. Our total liability to any user in any 12-month period shall not exceed the amount paid by that user to Elimora in that period.

12. Termination

We reserve the right to suspend or terminate accounts that violate these Terms or applicable law, without prior notice. Users may delete their own account at any time through the account settings or by contacting support@elimora.ke. Upon termination, access to the Platform ceases immediately. Data may be retained as required by law or for dispute resolution.

13. Governing Law and Disputes

These Terms are governed exclusively by the laws of the Republic of Kenya. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Kenya. We encourage users to contact us first to resolve disputes amicably before initiating legal proceedings.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email at least 14 days before taking effect. Continued use of the Platform after changes take effect constitutes your acceptance of the updated Terms.
